About the national data management system





On August 5, the Ministry of Economic Development published on the public discussion portal a draft federal law “On the National Data Management System and on Amendments to the Federal Law“ On Information, Information Technologies and the Protection of Information in the Russian Federation ”(hereinafter - the NSDS). The bill is aimed at creating a system that allows for a uniform approach to working with government data, to improve their quality, as well as the efficiency of their use. According to the explanatory note to the bill, it was developed pursuant to clause 01.01.009.008.001 of the action plan of the federal project “Normative regulation of the digital environment” of the passport of the federal project “Normative regulation of the digital environment” of the national program “Digital Economy of the Russian Federation”, paragraphs 4, 5 of the action plan (“Roadmap”) for the establishment of a national data management system for 2019–2021.



The bill forms a special terminology, reinforcing the definition of such concepts as “ state data ”, “ processing of state data ”, “ state information resource ”. As a result, it will be necessary to amend the federal law of July 27, 2006 No. 149- “On Information, Information Technologies and the Protection of Information” in order to lead to a common denominator of the definition of “ state information resource ” and “ information resource ”, as well as to provide the possibility of creating a GIS not only on the basis of statistical, documented information, but also on the basis of other information, to determine the general procedure for regulating issues related to ensuring the quality of data, the explanatory note says.



So, the bill defines “ state data ”. State, municipal data (hereinafter referred to as state data) is information processed by:





The procedure for concluding such agreements, including their standard conditions and cases of their conclusion, is established by the government of the Russian Federation.



The provisions of the bill will not apply to data that does not fall within the definition of state data, including data that constitutes state secret, as well as commercial and other limited access information provided for by the legislation of the Russian Federation.



Key requirements for processing state data will be established by the government of the Russian Federation.



In accordance with the bill, the authorities, the Central Bank of the Russian Federation and a number of organizations (including state corporations, state companies, natural monopolies, etc.) will have to switch to a systematic organization of work in the field of formation (collection, recording, systematization, research, analysis, accumulation), changes, storage, use (provision (exchange), distribution), deletion, transformation of state data.



The system is a combination of methodological, legal, organizational, managerial, and information technology elements that ensure coordination at the federal, regional, and municipal levels of processing state data.



The implementation of the bill should also ensure the systematization and management of the volumetric flow of digital content created by the state, the comparison and verification of state data, their monitoring and control through the data management infrastructure, which includes, along with the federal state information system being designed, the “Unified information platform of the national data management system” register of information interactions, federal state information systems "Digital analytics platform to provide statistical data", as well as other information systems.



The provisions of the draft law providing for the mandatory support by the infrastructure for managing data of interaction with certain elements of the e-government infrastructure, including those providing interdepartmental electronic interaction, the uniform presentation of regulatory reference information, maintaining in electronic form a register of state and municipal services, functions for the implementation of state control (supervision) and municipal control, as well as with other information systems ANTONOV and organizations will form a unified information technology control environment and quality control of data.



Thus, the system will allow authorities to eliminate the reasons for the inefficiency of public administration by reducing the number of errors associated with a low level of completeness, reliability and efficiency of obtaining government data. Organizations that join the system will have the opportunity to increase business manageability through the use of timely, relevant and reliable government data, as well as by reducing the unjustified and excessive administrative (reporting) burden on business representatives and the non-profit sector. Citizens, in turn, will have the opportunity of non-discriminatory access to data. They will not only know what information the state knows about them, but also make decisions regarding its disclosure to business.



On August 23, at a meeting of the Subcommittee on Digital Economy of the Government Commission on Digital Development, the functional and technical requirements for the Federal State Information System “Unified Information Platform of the National Data Management System” were approved.



On September 10, 2019, the Ministry of Communications announced a competition for the creation of the first stage of the Unified Information Platform of the National Data Management System (NSDM). The cost of work is estimated at 479.7 million rubles.
