Roskomnadzor forbade third parties to use the data of users "VKontakte"

The other day it became known that Roskomnadzor banned third-party companies from collecting and using information from users of the Vkontakte social network. This refers to information that is publicly available. It is usually considered that if information is open, then anyone can collect and use it. Indeed, according to the Law on Personal Data, the processing of personal data (PD) is allowed, access to which was provided by the owner himself, as reported by Izvestia.



At the same time, art. 9 of the same law indicates that the processing of data of users of social networks is possible only with their consent. β€œIn accordance with clause 5.12 of the user agreement of the Vkontakte network, the user agrees only to access the information that he places on his personal page, including his personal data. The user does not give consent to the collection, processing and transfer to third parties, ”the press service of Roskomnadzor said.



Moreover, if the user has not given his explicit consent to the processing of his data, then they can not be stored, processed and transmitted. Roskomnadzor also noted that if this practice existed previously, then it should be stopped.



In principle, social networks for a relatively long time began to more closely monitor who and how uses the data of users of such resources. For example, in March of this, the company Facebook decided to prohibit the use of information laid out by its users, a third party to track people's behavior. The company believes that people who register on the social network should feel protected, be sure that their information is not used by anyone else for any purpose.



In "Vkontakte" went even further. At the very beginning of this year, the social network filed a lawsuit against several companies that decided to search for profiles of their clients in the social network and determine solvency by the content of the pages. Interestingly, this did not aim to get compensation - the amount of claims of the social network was only 1 ruble. That is, it was about exactly putting an end to this practice.



However, this point of view has opponents. β€œEither it is necessary to immediately restrict access to this data, or to give everyone the opportunity to use them. Now the situation resembles the case when a person hung a photo on the fence, but forbade her to look at it. Any company can use publicly available data. And it does not matter what the social network user agreement says, third-party companies are not bound by this agreement. In addition, the social network itself will not be able to control who collects the data of its users, ”said Sergey Kopylov, deputy director of the Coordination Center of the National Internet Domain for Legal Issues.



Whatever it was, and Roskomnadzor has already spoken on this issue, so, most likely, everyone else will have to obey.
